Terms of Service

Welcome to GoTender ("Platform", "we", "us"). By accessing or using the Platform, you ("User") agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Platform.
1. About the Platform
GoTender is an aggregator service that compiles publicly published tenders, requests for quotation (RFQs), and grants from Malaysian government agencies, statutory bodies, government-linked companies (GLCs), and other organisations, presented for User reference.
2. No Affiliation with Any Agency
The Platform is an independent service and is NOT affiliated with, sponsored by, endorsed by, or officially recognised by any government agency, ministry, statutory body, GLC, local authority, or organisation whose sources we display. Agency logos, names, and trademarks shown remain the property of their respective owners and are used solely for identification and reference.
3. Disclaimer of Information Accuracy
Information displayed on the Platform is provided "as-is" for assistance and reference only. While we make reasonable efforts to keep information current, we DO NOT warrant the accuracy, completeness, timeliness, or validity of any tender, RFQ, or grant information shown.
Users are SOLELY RESPONSIBLE for verifying every piece of information directly with the publishing agency through their official portal or official communication channels before submitting any bid, offer, or commercial decision. We are not liable for any loss, damage, or disappointment arising from reliance on Platform information.
4. User Accounts
Certain features require an account. You are responsible for:
- Providing accurate, current, and truthful information including your company details and MOF certificate;
- Maintaining the confidentiality of your account password;
- All activities that occur under your account;
- Notifying us immediately of any unauthorised use.
We reserve the right to suspend or terminate accounts that violate these Terms without prior notice.
5. Subscriptions and Payments
Paid plans are sold as one-off payments per monthly or yearly period. Payment is processed via Stripe (credit/debit card, FPX, GrabPay). Access ends automatically at the end of the period and must be renewed manually.
No refunds are issued for periods that have begun, except in cases of clear billing error or as required by Malaysian law.
6. Acceptable Use
You AGREE not to:
- Scrape, bulk-copy, or redistribute Platform data for commercial purposes;
- Use the Platform for unlawful activities;
- Attempt to disrupt, hack, or overload the Platform infrastructure;
- Share account access with parties outside your authorised company team;
- Submit false statements or falsified company documents.
7. Intellectual Property
The Platform's compilation, design, interface, code, and service features are the property of GoTender. Underlying tender content remains the property of the publishing agency. You are granted a limited, non-exclusive, non-transferable licence to use the Platform for personal or internal company use.
8. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS-IS" AND "AS-AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.
9. Limitation of Liability
To the extent permitted by Malaysian law, our maximum aggregate liability for any claim related to the Platform shall not exceed the subscription fees you have paid in the twelve (12) months preceding the claim. We are NOT liable for any indirect, incidental, special, consequential, or punitive damages including lost profits, business opportunities, contracts, or data.
10. Indemnification
You agree to indemnify and hold GoTender, its directors, employees, and agents harmless from any claim, loss, or cost (including legal fees) arising from your use of the Platform or breach of these Terms.
11. Termination
You may terminate your account at any time via the settings page. We may also terminate access for breach of these Terms. Payments made for the current ongoing period are not refundable.
12. Changes to Terms
We may update these Terms from time to time. The update date will be shown at the top of this page. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by Malaysian law. Any disputes will be subject to the exclusive jurisdiction of the Courts of Malaysia.
